These Terms and Conditions govern your use of this website and any engagement of services from Together Global Business Services Pvt Ltd. By accessing this website or engaging our services, you agree to be bound by these Terms. We recommend that this document is reviewed by a qualified Indian legal practitioner before reliance.

1. About Us

Together Global Business Services Pvt Ltd (known as 'Together Global India', and referred to as "Together Global", "we", "us" or "our") is a company registered in India. We provide cross-border delivery consulting and the Teams in Flow programmes to Indian and global organisations.

These Terms apply to your use of www.togetherglobal.in and to any services you engage from us. By using this website or engaging our services, you confirm that you accept these Terms and agree to comply with them.

2. Our Services

Together Global provides the following services under the Teams in Flow methodology:

  • Active Teams - a delivery diagnostic and intervention programme for live cross-border teams, comprising the Friction Audit, Friction-to-Flow Workshop and Flow State
  • New Teams - a 90-day programme for organisations establishing new GCCs or offshore delivery centres, comprising the Pre-Launch Readiness Assessment and 90-Day Flow Setup
  • Applied - consulting services applied to M&A integration, leadership onboarding, graduate programmes and AI operating model design

The specific scope, deliverables, timeline and fees for any engagement will be set out in a separate written proposal or Statement of Work agreed between the parties prior to commencement.

3. Engagement of Services

An engagement of our services is formed when both parties have signed or otherwise confirmed in writing an agreed Statement of Work or proposal. Submission of an enquiry through this website does not constitute a binding engagement of services.

We reserve the right to decline any enquiry or proposed engagement at our sole discretion.

4. Fees and Payment

All fees will be specified in the applicable Statement of Work or proposal. Unless otherwise agreed in writing:

  • Fees are quoted and payable in Indian Rupees (INR) unless otherwise specified
  • Invoices are payable within 30 days of the invoice date
  • Late payment interest may be charged at the rate applicable under the Interest Act, 1978
  • All fees are exclusive of applicable taxes, including Goods and Services Tax (GST), which will be charged in addition at the prevailing rate
  • Expenses reasonably incurred in delivering services (travel, accommodation etc.) will be invoiced separately unless included in the agreed fee

5. Intellectual Property

All intellectual property rights in the Teams in Flow methodology, frameworks, tools, content and materials developed by Together Global (including the Friction Audit methodology, workshop materials and diagnostic tools) remain the exclusive property of Together Global and its licensors.

Upon full payment of all fees, we grant you a non-exclusive, non-transferable licence to use the deliverables produced specifically for your organisation under the applicable Statement of Work, for your internal business purposes only.

All content on this website, including text, design elements and structure, is protected by applicable intellectual property law. You may not reproduce, distribute or create derivative works without our prior written consent.

6. Confidentiality

Each party agrees to keep confidential all non-public information disclosed by the other party in connection with an engagement, and not to disclose such information to any third party without the other party's prior written consent, except:

  • Where required by applicable law or by order of a competent court or regulatory authority
  • To professional advisers who are themselves bound by equivalent confidentiality obligations
  • Where the information is or becomes publicly available through no fault of the receiving party

Confidentiality obligations survive the termination or expiry of an engagement for a period of three years.

7. Data Protection

Each party agrees to comply with its obligations under applicable data protection law, including the Digital Personal Data Protection Act, 2023, in connection with any personal data processed in the course of an engagement. Where Together Global processes personal data on behalf of a client organisation, the parties will enter into a data processing agreement on terms compliant with applicable law.

Our collection and use of personal data through this website is described in our Privacy Policy.

8. Limitation of Liability

To the fullest extent permitted by applicable law:

  • Together Global's total aggregate liability to you in connection with any engagement, whether in contract, tort (including negligence) or otherwise, shall not exceed the total fees paid by you under the applicable Statement of Work in the 12 months preceding the claim
  • Together Global shall not be liable for any indirect, consequential, special or punitive loss or damage, including loss of profit, revenue, business or goodwill, whether or not such loss was foreseeable
  • Nothing in these Terms limits liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded under Indian law

9. Warranties and Disclaimers

Together Global warrants that it will deliver its services with reasonable skill, care and diligence. We do not warrant that the outcomes of any engagement will meet any specific performance targets, as results depend on factors outside our control including the engagement and cooperation of your organisation and team members.

The content on this website is provided for general information purposes only and does not constitute professional advice. While we take care to ensure accuracy, we make no representations or warranties as to the completeness or currency of the content.

10. Termination

Either party may terminate an engagement:

  • By giving written notice as specified in the applicable Statement of Work
  • Immediately, if the other party commits a material breach of these Terms or the Statement of Work and fails to remedy it within 14 days of written notice requiring it to do so
  • Immediately, if the other party becomes insolvent, is wound up, or a receiver or administrator is appointed over any of its assets

On termination, you will pay for all services delivered up to the date of termination. Clauses 5, 6, 7, 8 and 12 survive termination.

11. Website Use

You agree to use this website only for lawful purposes and in a manner that does not infringe the rights of any third party. You must not:

  • Use this website in any way that violates applicable Indian law or regulation
  • Attempt to gain unauthorised access to any part of this website or its underlying systems
  • Transmit any unsolicited communications or harmful code through this website
  • Reproduce or misrepresent any content from this website without our prior written consent

12. Governing Law and Dispute Resolution

These Terms and any engagement of our services are governed by and construed in accordance with the laws of India.

In the event of any dispute arising out of or in connection with these Terms or any engagement, the parties agree to first attempt to resolve the dispute through good faith negotiation. If the dispute is not resolved within 30 days of written notice, either party may refer the matter to arbitration under the Arbitration and Conciliation Act, 1996, with the seat of arbitration in Bengaluru and proceedings conducted in English.

Nothing in this clause prevents either party from seeking urgent injunctive or other interim relief from a competent court.

13. General

  • Entire agreement - these Terms, together with any applicable Statement of Work, constitute the entire agreement between the parties and supersede all prior discussions and agreements relating to the subject matter
  • Variation - we may update these Terms from time to time. Material changes will be reflected by an updated "Last updated" date. Continued use of this website following such changes constitutes acceptance
  • Severability - if any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force
  • Waiver - failure to enforce any provision of these Terms does not constitute a waiver of the right to enforce it subsequently
  • Force majeure - neither party shall be liable for delays or failures in performance resulting from circumstances beyond its reasonable control
